Alabama Cannabis Controversy: Judge Urges Resolution as Decision Nears

The executive director of the Alabama Cannabis Industry Association (AMCC) called for cooperation among parties involved in the licensing dispute during a court hearing on Monday.

AMCC’s executive director, Chey Garrigan, urged the cultivation and processing businesses to proceed with their operations while the legal issues were being addressed.

According to the judge, the allegations of Open Meetings Act violations by the AMCC were not discussed during the hearing. Instead, the judge emphasized the need for the parties to reach a consensus.

Background

The AMCC is attempting to redo the medical cannabis licensing process after two failed attempts. However, Montgomery Circuit Judge James Anderson, who temporarily halted the licensing process in response to a legal action, has reservations.

Representing affected businesses, Will Somerville expressed concerns over the lack of transparency in the licensing process. He argued that the debate should be public to ensure transparency and accountability.

During the hearing, Somerville expressed optimism that a fair decision would be reached that complies with the Open Meetings Act and due process requirements.

Next Steps

On Thursday, the medical cannabis commission will hold a meeting to vote on a pause in issuing business licenses. The court will reconvene next Wednesday to discuss the case and explore approaches to move forward with the licensing process.
