On Wednesday, Meta Platforms, Inc. and TikTok, owned by ByteDance, challenged the European Union’s supervisory fees under the Digital Services Act in the EU General Court, contending that the fee calculations are flawed and disproportionately high. The fee is set at 0.05% of a company’s global net income to cover the European Commission’s compliance oversight costs.
Meta’s lawyer, Assimakis Komninos, argued that the fee’s calculation method was “opaque” and resulted in “implausible” figures by using overall revenue instead of individual subsidiary income. TikTok’s lawyer, Bill Batchelor, described the calculation method as “inaccurate” and claimed it unfairly included costs pertaining to other platforms.
The court is expected to rule on the matter next year. Notably, the EU has designated 20 major online platforms, including Google and Apple, as subject to this levy based on their average monthly active users and previous year’s financial performance.
