Here is a short summary of the bill:

This bill, titled the

Deport Alien Gang Members Act

, aims to amend existing U.S. immigration laws specifically related to individuals who are part of criminal gangs. Here is a summary of its main components:

Definition of Criminal Gangs

The bill seeks to establish a clear definition of what constitutes a “criminal gang.” It defines a criminal gang as an ongoing group of five or more individuals whose primary purpose is to commit specific offenses, which include but are not limited to:

  • Drug-related offenses that carry a penalty of more than one year in prison.
  • Firearm or explosive-related offenses.
  • Violent crimes.
  • Trafficking, fraud, and other serious crimes.

Inadmissibility and Deportability

The bill creates grounds for both inadmissibility and deportability of individuals associated with criminal gangs:

  • Inadmissibility:

An individual can be deemed inadmissible (i.e., not allowed to enter the U.S.) if they are known or believed to be a gang member, have promoted or aided gang activities, or sought to enter the U.S. to participate in gang activities.

  • Deportability:

Individuals who are or have been gang members, or have aided gang activities, can also face deportation from the U.S.

Designation of Criminal Gangs

The bill allows the Secretary of Homeland Security, in consultation with the Attorney General, to designate a group of five or more persons as a criminal gang. This designation would follow a specific procedure, including:

  • Notification to congressional leaders prior to the designation.
  • Publication of the designation in the Federal Register.
  • Creation of an administrative record to support the designation.

Mandatory Detention

Under the proposed legislation, individuals deemed gang members would face mandatory detention. This amendment requires the Secretary of Homeland Security to submit an annual report on the number of individuals detained under these provisions.

Claims Based on Gang Affiliation

The bill introduces revisions restricting asylum and other immigration relief for individuals associated with criminal gangs. Specifically, it denies asylum to individuals who are gang members or have participated in gang activities.

Temporary Protected Status and Other Immigration Benefits

Individuals who are or have been associated with criminal gangs would also be ineligible for Temporary Protected Status, special immigrant juvenile visas, and general immigration relief under U.S. laws.

Effective Date

The amendments proposed would take effect upon the enactment of the bill and apply retroactively to all actions, regardless of when they occurred.
